Risks to the lead
- Fact-check exposure on the FirstEnergy/HB6 ads. FactCheck.org (2026-09-17) found that it's true Husted backed the 2019 bailout law and that the company supported his campaigns, but "Husted hasn't been charged with or accused of any wrongdoing", which is the impression the ads may leave. Cleveland.com (2026-10-21) also rated one claim in a Brown farm-costs ad false. Repeated rebukes like these erode the credibility of Brown's contrast.
- Outside money closing late. Brown's money edge is in candidate funds. Pro-Husted PACs (Reuters, 9/21) can cancel out his cash-on-hand parity in the final week.
- The tone backlash runs both ways. The Columbus Dispatch poll op-ed (9/29) says Ohioans are "sick of toxicity". The NRSC crash-photo ad (OCJ 8/28) and the ad featuring Acton's mother (The Hill 10/20) hurt Husted, but WKRC (10/1) reports a Brown ad that used vulgar language.
What's working
Ads that frame Husted as Washington's man. The NYT (9/28) ran the headline "Are You the Incumbent?", which plays into Brown's own long Ohio identity.
The fundraising scale (3.4x Husted's receipts).
Pressure on Husted to disown the outside-group ads (Acton ad, crash-photo ad), which keeps the coverage on Husted's tone.
Top 5 recommendations
Reword the HB6 line to match what the fact-checkers verified. Draft: "Jon Husted backed the 2019 bailout law that FirstEnergy wanted, and FirstEnergy supported his campaigns." This is VERIFIED per FactCheck.org 2026-09-17. Do not say or imply he was charged.
Pull or fix the farm-costs claim that Cleveland.com rated false (10/21). Line needs verification against the specific rating before it airs again.
Close on affordability and data-center power costs (Signal Ohio 7/8; OCJ 8/10, contrasting data-center positions). Line needs verification: Husted's specific statements were not retrieved.
Drop vulgar language and run contrast without profanity, taking advantage of the voter fatigue with toxic ads (Dispatch 9/29). This is a judgment call, not an ad line.
Tie Husted to his recorded Senate votes. Drafts, worded as recorded:
"Jon Husted voted for the big bill on July 1, 2025. It passed 50–50, on the Vice President's tiebreak."
Senate roll 372 (119th, 1st sess.), H.R. 1 "On Passage of the Bill", 2025-07-01, Husted Yea.
"Jon Husted voted no on all 15 Senate votes on resolutions to remove U.S. forces from hostilities with Iran."
Husted Nay on every Iran war-powers vote in voteview, from the S.J.Res. 59 motion to discharge (2025-06-27, sess. 1 roll 328) through H.Con.Res. 89 adoption (2026-09-24, sess. 2 roll 244). 12 were motions to discharge, 1 a motion to proceed, 2 adoption votes. Say "voted no", not "voted for war".

What changed since 10-27
Outside-ad claims, checked (WSYX fact-check): the claim that "Husted was mentioned 386 times at trial" comes from a state Democratic release and cannot be independently checked, so it is unsafe. "FirstEnergy... spent at least $3.5M" refers mostly to super PAC spending, not money given directly to Husted, so the line is corrected. The 61% electricity-bill claim has no source or time period, so it is unsafe. https://abc6onyourside.com/news/election/fact-check-how-truthful-sherrod-brown-jon-husted-campaign-ads-politics-political-midterm-midterms-senate-senator-race-contest-republican-gop-democrat-ohio (fetched 2026-10-29)
Suffolk (Oct 21–26) adds an independent D+3; aggregates narrowed ~0.5 pt to Brown +3.1–3.5.
Statewide early vote passed ~1.19M (secondary tracker).
No new FEC filing retrieved (FEC API rate-limited); pre-general totals unchanged.
